Purchases - Returns, Terms & Conditions

By purchasing any item from Kleister's Sounds of Yesteryear, you are agreeing to the legally enforceable and defendable terms displayed below.

1. Consumer Contracts Regulations and the Consumer Rights Act

1a. Although the nature of the goods we sell are 'specialist', as a customer; and in the eyes of the law you are fundamentally purchasing second hand goods from a 'trader' acting in a self employed capacity.

1b. As the consumer, you are able to cancel a transaction and return the goods for a full refund within 14 working days. PLEASE NOTE - Due to the nature of the products we sell, value of parts and fragile nature - your 14 day statutory rights are limited to and only if, the item has not been opened, used or handled. Security measures are put in place to legally prove the opening, inspection, use or handling of any item sold by us on a private, online and retail shop basis. Items sold within our 'Project & Parts Equipment' category will only be accepted if complete as sold, upon return. 

1c. Example 1 - Items posted, will include secure security seal foils to operating switches and/or and not limited to lids, opening catches, connections etc. We will also be aware if the original tape on packaging is disturbed, all parcels being photographed in high definition and logged before dispatch.

1d. Example 2 - Items purchased from our retail shop are fully demonstrated and fully inspected and handled by yourself as the consumer. Upon purchasing and leaving our premises, security foil may be placed on the power lead or plug for example. Other locations for such security measures may include security foil on lid closures and catches. 

2. Standard Returns Enquiries outside of the Consumer Rights act. 

2a. As the consumer, please be aware; that we do not accept 'change of heart or mind', 'claims of mis-description' or 'charge back request' returns. Any of these will be legally declined and legally enforced/defended if required.

2b. We look after our customers, and having over 400 repeat customer transactions to date, we must be doing something right! If for any reason you happen to be unhappy with a purchase, get in touch; in reasonable time and we will try and make arrangements to ensure you are another one of our happy customers.

2c. -If your purchased item fails, we cover all newly fitted parts(only) for 30 days. Contact us to arrange the return of your item and we will repair it (Consumer/Customer covers the cost of return).

2d. -Changed your mind? We may be able to offer advice and help if you so decide you no longer want your item, we would be happy to assist and advise in the sale or finding your equipment a new home. If we have something in stock more suitable, we may even be able to offer a part exchange arrangement.

2e. Postage and Shipping - In the unlikely event an item is 'lost in the post' or 'damaged during shipping' assurance is present in the fact that all articles posted are fully insured by the service agent(s) we use. If it is required to claim on the shipping services insurance for loss or damage the consumer/customer will be reimbursed when the company providing the shipping service and/or insurance reimburses us. Unfortunately due to the size of the business and financial constraints we are unable to reimburse customers in advance of confirmation of loss or damage. In the unlikely event, the insurance or shipping provider are delayed in settlement or dispute a claim, the consumer/customer will be expected to wait. If a loss of damage claim is refused 'for example - delivery is confirmed with signature but consumer/customer claims to have not received item'; responsibility and liability at this point is relinquished and we will provide the customer with required documentation of confirmation of postal/courier service for them to pursue the matter themselves as an individual. We will assist in this as much as we can.

As mentioned before, by purchasing any item from Kleister's Sounds of Yesteryear, you confirm your acceptance of all; of the legally enforceable and defendable terms listed above in both sections 1, 2 and 3. 

3. Purchasing vintage Electronic devices, equipment, appliances and the law

3a. Vintage equipment is SIMPLY THE BEST! But, Vintage equipment is 'old' and generally, you will find it may not meet modern safety standards. In regards to 'The Electrical Equipment (Safety) Regulations 1994 act' and 'Portable appliance testing fields' - Many vintage electronics would be generally condemned by these rulings for manufacture today. But the sale of such items is perfectly within the law, either under a spares or repairs basis (not working) or under a 'As safe as limited by design', incorporating and ensuring both cables and plugs are safe at time of sale, recognised and conform with the latest standards, for example 'BS 1363'

3b -No Warranty or guarantee is implied or given with ANY services or sale we provide. Aging, original parts will remain in your equipment and future maintenance may and mostly likely will be required. 

3c -Vintage equipment is used at your own risk and we accept no liability for loss, damage to property or injury from proper or improper use.

As mentioned before, by purchasing any item from Kleister's Sounds of Yesteryear, you confirm your acceptance to all legally enforceable and defendable terms listed in sections 1, 2 and statement surrounding liability in section(s) 3.

 

Restorative and Repair Services

Both Electronic and Mechanical

Included in these terms; sections applicable to items the consumer may wish to sell to Kleister's Sounds of Yesteryear

By proceeding with any repair, servicing or restoration transaction with Kleister's Sounds of Yesteryear, you are agreeing to the terms displayed below.

4. Restoration, Servicing and Repair services provided by Kleister's Sounds of Yesteryear; the process, terms and notes of relinquished liability.

4a. Vintage equipment is SIMPLY THE BEST! But, Vintage equipment is 'old' and generally, you will find it may not meet modern safety standards. In regards to 'The Electrical Equipment (Safety) Regulations 1994 act' and 'Portable appliance testing fields' - Many vintage electronics would be generally condemned by these rulings for manufacture today. But the use and maintenance of such items is perfectly within the law. The Majority of equipment we maintain for customer is 'As safe as limited by design', incorporating and ensuring both cables and plugs are safe at time of sale, recognised and conform with the latest standards, for example 'BS 1363'. We do have customers where period correct cabling and mains plugs is a must; in this instance a separate disclaimer of relinquished liability will have to be signed and addressed before your equipment is released.

4b. In line with 'The Toxic Substances Control Act of 1976' as a responsible provider of maintenance services to specialist equipment; Consumers/Clients/Customers should be aware that some of the consumables we use when carrying out our services contain substances that will fall into multiple Toxic Substances categories. For example we use Lead based solder, alcohol based products and other toxic substances for cleaning sensitive parts. We accept no liability for loss, damage, harm to life of people, or animals or costs incurred if there is an incident involving equipment or substances used whilst serviced by ourselves.     

4c -No Warranty or guarantee is implied or given with ANY services we provide. Aging, original parts will remain in your equipment and future maintenance may and mostly likely will be required. As a standard practice, newly replaced parts are covered by ourselves for a period of 30 working days from point of collection. If any failure occurs of this type, the consumer/customer is responsible for the cost of returning equipment for secondary repair to our trading address.

4d -Vintage equipment is used at your own risk and we accept no liability for loss, damage to property or injury from proper or in-proper use.

4e -Equipment booked in for quotation will be processed and quotations given by arrangement and prior booking/discussion. In the event of abandoned equipment, if reasonable contact has not been made within 60 days of first attempt of quotation delivery, a storage fee will apply of £10.00 per week, per item, 50% of which will be donated to charity.

4f -Following the terms stated in section 4e, equipment will be claimed by Kleister's Sounds of Yesteryear for re-sale to cover storage charges or disposed of responsibly and in line with local authority rulings after 12 months has lapsed.

4g -Equipment/items left at the property, shop or in the building without prior arrangement, will not be tolerated and will be handed in to Local Police after 7 days. If contact details are left, you will be contacted and expected to collect your equipment within 7 days. There is an official 'booking for quotation system' in place inline with our insurance provisions and these must be met. This also applies to equipment or items you are hoping to sell to us, the same terms apply and prior arrangement is required.

As mentioned before, by engaging in any restoration, servicing or repair services with Kleister's Sounds of Yesteryear, you confirm your acceptance to all terms listed in section 4.

Our terms of Sale, Return, Restorative services and relinquishment of liability laid out and listed in detail above are both legally enforceable and defendable. In the unlikely event that these are challenged or breached legal assistance/services will be obtained.
